Agreement Between User and https://saltedwellnessstudio.com . Welcome to https://saltedwellnessstudio.com (the "Site"). The Site is operated by Salted Wellness ("Salted Wellness") and constitutes an E-Commerce platform consisting of various webpages designed to provide information and facilitate interaction with Salted Wellness services. By accessing or using the Site, you agree to be legally bound by all terms, conditions, and notices set forth herein (the "Terms"). Please review these Terms carefully and retain a copy for your records.

The Site provides users with information regarding: (a) Salted Wellness studio locations, class schedules, instructors, and studio policies; (b) Salted Wellness training programs; and (c) pricing for new clients, packages, and memberships. Additionally, the Site integrates with Mariana Tek for class scheduling and Zendesk for customer support, enabling users to manage accounts and submit inquiries.

Communications

By visiting the Site or corresponding with Salted Wellness via email, you are engaging in electronic communications. You consent to receive such communications electronically and agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement for written communication.

Any content submitted by you through the Site, including messages, data input, or other communications (collectively, "Communications"), grants Salted Wellness a perpetual, worldwide, irrevocable, royalty-free, non-exclusive license to use, reproduce, adapt, distribute, publicly perform, display, transmit, modify, and sublicense such Communications in any medium now known or later developed. You waive any and all rights related to privacy, publicity, moral rights, and attribution in connection with such Communications.

Your Account

If you create an account on the Site, you are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. You may not assign or transfer your account to another individual or entity. Salted Wellness is not liable for unauthorized access to your account due to theft or other unauthorized means. Salted Wellness reserves the right to terminate accounts, refuse service, and remove or edit content at its sole discretion.

Age of Use of the Site

Salted Wellness does not knowingly collect personal information from individuals under the age of thirteen (13). Individuals under the age of eighteen (18) may use the Site only with the express consent and supervision of a parent or guardian.

Cancellation/Refund Policy

Auto-Renewal Memberships: These are non-contractual. A written cancellation notice must be submitted at least thirty (30) days prior to your next auto-renewal date. The final monthly membership fee is payable in full for all cancellations, including those following a membership freeze. Cancellations must be submitted via a support ticket using the member support function on the Site and cannot be processed in person at studio locations. Memberships cannot be cancelled on the same day they are purchased. Therefore, a minimum two-month commitment (initial and final month) is required for all auto-renew memberships.

Prepaid Memberships: These may be cancelled at any time prior to the next renewal period. Prepaid memberships will automatically renew for the same term unless cancelled. Memberships purchased via the online store become active immediately. If you wish to purchase a membership with a future start date, or to upgrade or downgrade an existing membership, you must submit a support ticket.

Scheduling

Class schedule adjustments can be made via the Site or its associated mobile application. Cancellations must occur at least six (6) hours prior to the scheduled class start time to avoid penalty fees. A $10 Late Cancel fee applies to cancellations made within this window. A $20 No-Show fee applies for missed classes.

Limited Memberships (e.g., 4, 8, or 12 classes per month): A class credit will be reinstated for a late cancellation or no-show penalty if requested within seventy-two (72) hours of the original class time. Unused classes do not roll over and must be used within the 30-day billing cycle. Manual class credits may take time to reflect in your account. Classes booked using a package, Single Class, or Guest Class credit are forfeited in the event of a late cancel or no-show.

Links to Third-Party Sites / Third-Party Services

The Site may include links to external websites ("Linked Sites") that are not operated or controlled by Salted Wellness. Salted Wellness assumes no responsibility for the content or practices of any Linked Site and provides such links solely for user convenience. The inclusion of any link does not imply endorsement or affiliation.

Certain services accessible via the Site may be provided by third-party entities under contract with Salted Wellness. By utilizing such services, you consent to the sharing of information as necessary to facilitate the requested service or functionality.

No Unlawful or Prohibited Use / Intellectual Property

You are granted a limited, non-transferable, non-exclusive, revocable license to access and use the Site in accordance with these Terms. You agree not to use the Site for any unlawful or prohibited purpose, or in any manner that could damage, disable, overburden, or impair the Site’s functionality or interfere with the use by others.

All content on the Site, including text, graphics, logos, images, software, and the compilation thereof, is the property of Salted Wellness or its licensors and is protected under applicable copyright and intellectual property laws. You shall not alter, copy, transmit, distribute, perform, display, sell, license, or create derivative works from such content without prior written consent from the rights holder. Your use of the Site does not grant ownership or license in any intellectual property beyond what is expressly permitted.

International Users

The Site is controlled and operated by Salted Wellness from its offices within the United States. Users accessing the Site from outside the United States are responsible for compliance with their local laws and regulations. You agree not to use the content or services of the Site in any manner prohibited by applicable law in your jurisdiction.

Indemnification

You agree to indemnify, defend, and hold harmless Salted Wellness, its affiliates, officers, directors, employees, agents, and third parties from any claims, liabilities, losses, costs, or expenses (including reasonable attorneys’ fees) arising from your use of the Site or its services, your violation of these Terms, or your infringement upon the rights of any third party.

Arbitration

In the event of any dispute arising from or relating to these Terms, the parties agree to resolve such dispute exclusively through binding arbitration pursuant to the Federal Arbitration Act. The arbitration shall be conducted by a single neutral arbitrator and administered by the American Arbitration Association or another agreed-upon provider. The arbitration shall take place in Morgan County, Utah, unless otherwise agreed in writing.

The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction. The prevailing party shall be entitled to recover reasonable attorney’s fees and costs. This arbitration provision shall survive termination of these Terms.

Liability Disclaimer

THE SITE AND ALL INFORMATION, PRODUCTS, SERVICES, SOFTWARE, AND RELATED MATERIALS PROVIDED THEREIN ARE OFFERED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND. SALTED WELLNESS AND ITS SUPPLIERS EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL SALTED WELLNESS OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF USE, DATA, OR PROFITS, ARISING OUT OF OR RELATING TO THE USE OR INABILITY TO USE THE SITE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF YOU ARE DISSATISFIED WITH THE SITE, YOUR SOLE REMEDY IS TO DISCONTINUE USE.

Termination / Access Restriction

Salted Wellness reserves the right, at its sole discretion, to terminate your access to the Site and related services at any time without notice. These Terms are governed by the laws of the State of Utah, and any legal action shall be brought exclusively in the courts of Morgan County, Utah. If any provision of these Terms is found to be invalid or unenforceable, the remainder shall continue in full force and effect.

No joint venture, partnership, employment, or agency relationship is created between you and Salted Wellness through your use of the Site. Compliance with governmental and legal requirements shall take precedence over any conflicting provision herein. These Terms constitute the entire agreement between you and Salted Wellness regarding the Site.

Changes to Terms

Salted Wellness reserves the right to amend these Terms at its sole discretion. The most current version shall supersede all prior versions. Users are encouraged to periodically review the Terms to remain informed of any updates.
